Terms and Conditions For Foxtail Landscaping

These Terms and Conditions (“Terms”) govern the provision of landscaping services by Foxtail Landscaping (“Company,” “we,” “us,” or “our”) to you, the client (“Client,” “you,” or “your”). By requesting or accepting services from Foxtail Landscaping, you agree to be bound by these Terms.


1. Service Agreement

1.1 Estimate and Scope of Work

All services are based on a written estimate provided by Foxtail Landscaping. The estimate outlines the agreed scope of work, including specific services, materials, timelines, and estimated costs. Any services outside the original scope require a revised estimate or written approval.

1.2 Acceptance

Your acceptance of the estimate—verbally, in writing, electronically, or by allowing work to begin—constitutes agreement to these Terms.


2. Pricing and Payment

2.1 Pricing

Quoted prices are valid for [Number] days from the date of issue unless stated otherwise.

2.2 Payment Terms

Payment is due in full upon completion of services unless otherwise agreed in writing. Larger projects may require deposits or phased payments.

2.3 Payment Methods

3. Client Responsibilities

3.1 Site Access

Clients must provide safe and unobstructed access to work areas. Delays or added costs due to restricted access may be billed to the Client.

3.2 Utility Lines

Clients are responsible for identifying underground utilities (water, gas, electrical, irrigation, septic). Foxtail Landscaping is not liable for damage to unmarked utilities. Clients are encouraged to contact local utility marking services before work begins.

3.3 Permits and Approvals

Clients must obtain any required permits or homeowner association approvals.

3.4 Removal of Obstructions

Vehicles, furniture, décor, or personal items must be cleared from work zones prior to service.

3.5 Pets and Safety

Pets must be secured away from active work areas for safety.


4. Company Responsibilities

4.1 Professional Workmanship

Foxtail Landscaping commits to performing services safely, professionally, and in accordance with industry standards.

4.2 Insurance

We maintain appropriate liability and workers’ compensation insurance. Proof is available upon request.

4.3 Cleanup

Unless stated otherwise, all landscaping debris will be removed after service completion.

4.4 Property Damage

We exercise reasonable care to prevent damage. If damage occurs due to our negligence, we will repair or compensate accordingly. This excludes damage from unmarked utilities or client obstructions.


5. Landscaping Service Specifics

5.1 Hardscaping, Leveling & Installation

Any services such as paving, grading, drainage, turf installation, or garden construction must be explicitly included in the estimate.

5.2 Property Restoration

Minor ground settling, soil disruption, or landscape adjustment may occur and may require additional client-side restoration.


6. Limitations of Liability

6.1 Force Majeure

Foxtail Landscaping is not responsible for delays caused by weather, natural events, equipment failure, or other uncontrollable circumstances.

6.2 Pre-Existing Conditions

We are not liable for damages caused by existing soil instability, drainage issues, underground conditions, or hidden defects.

6.3 Consequential Damages

Our liability is limited to the cost of services performed. We are not responsible for indirect or consequential damages.


7. Cancellation Policy

7.1 Client Cancellation

Clients must provide at least [24–48] hours’ notice to cancel or reschedule. Late cancellations may incur a fee of [percentage or flat rate].

7.2 Company Cancellation

Foxtail Landscaping reserves the right to reschedule due to unsafe conditions or unforeseen circumstances.


8. Governing Law and Dispute Resolution

If any provision is deemed invalid, the remaining Terms shall continue in full effect.


By accepting services from Foxtail Landscaping, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
